Terms of use for Objektor

These terms govern the use of the Objektor service, provided by Laminar AS, company registration no. 934 010 779, Storgaten 60 D, 4876 Grimstad, Norway ("Laminar", "we"). By creating an account or using Objektor you accept these terms. The Norwegian version prevails if the two differ.
1. The parties and the agreement
The customer is the organisation that has entered into an agreement with Laminar on the use of Objektor. A user is a person the customer has given access to, such as employees, hired staff, contractors or the client's representatives. The customer is responsible for its users complying with these terms.
The agreement consists of these terms, any written agreement or order confirmation with pricing and scope, and the data processing agreement. In case of conflict, the written agreement prevails over these terms, and the data processing agreement prevails over both regarding personal data.
2. The service
Objektor is a map-based tool for registering and following up physical assets, issues, checklists, photos and documentation, available through the browser at app.objektor.io and the accompanying API. The service includes organisations, projects, roles, data import and export, and email notifications.
Objektor is in early access. We develop the service together with our first customers, features may be added, changed or removed, and errors may occur. We give the customer reasonable notice before changes that materially reduce functionality the customer depends on.
3. User accounts and access
- The customer manages who has access to its organisations and projects, and which role each user has.
- User accounts are personal and must not be shared. Users must keep their sign-in details secret and use a strong password.
- The customer and the user must notify us immediately if they suspect an account has been misused.
- The customer is responsible for all activity through its user accounts, unless the activity is caused by an error on Laminar's side.
- When a person leaves the customer, it is the customer's responsibility to remove their access.
- A user can request deletion of their user account by contacting us at hei@laminar.no.
4. Customer data
Everything the customer and its users register in Objektor ("customer data") is owned by the customer. Laminar receives a limited right to process customer data to the extent necessary to provide, operate, secure and improve the service and to give support. We do not use customer data for other purposes and do not share it with anyone other than the sub-processors named in the privacy statement.
The customer is responsible for ensuring that:
- it has the right to register and store the customer data, including photos that may show people, vehicles or private property,
- it has a legal basis for processing personal data within the customer data, and informs its own users that location and time are stored and stamped into photos taken in Objektor,
- customer data contains no unlawful content, malicious code or information the customer is not allowed to share, and
- it keeps its own backups of business-critical data in addition to ours.
The customer can export customer data from the service at any time. For personal data within customer data, the customer is the controller and Laminar the processor, governed by the data processing agreement. See also the privacy statement.
5. Acceptable use
The service must not be used to:
- break Norwegian law or infringe the rights of others,
- attempt to access other customers' data, bypass access control or test security without a written agreement with us,
- place abnormal load on the service, for example through automated calls beyond what the API is intended for, or
- copy, decompile or build a competing service based on Objektor.
On breach, we may temporarily suspend access for the user or customer concerned. We notify the customer as soon as possible and restore access once the matter is resolved.
6. Availability, support and maintenance
We aim to keep Objektor available around the clock, but during early access we do not guarantee uptime. Planned maintenance is scheduled outside normal working hours where possible and announced in advance. Support is provided by email to hei@laminar.no during normal working hours.
7. Pricing and payment
Pricing, billing period and payment terms are agreed in writing with each customer. Unless otherwise agreed, the service is invoiced monthly in advance with 14 days' payment terms. Price changes are announced in writing at least 30 days before they take effect, and apply from the next billing period at the earliest. All prices exclude VAT.
8. Intellectual property
Laminar owns all rights to Objektor, including software, design, documentation and trademarks. The customer receives a non-exclusive, non-transferable right to use the service for the duration of the agreement. Suggestions and feedback from the customer may be used freely in further development, without compensation.
9. Confidentiality
Each party shall keep confidential any non-public information it receives about the other party's business, and use it only to perform the agreement. This obligation survives termination.
10. Third-party services and data sources
Objektor is built on services from sub-processors: Google Cloud (hosting and storage in the EU), Clerk (sign-in), Resend (email notifications) and Mapbox (maps). Map content from Mapbox is subject to Mapbox's terms. Road references are retrieved from the Norwegian National Road Database (Statens vegvesen) and addresses from the Norwegian Mapping Authority (Kartverket), both open data under the Norwegian Licence for Open Government Data (NLOD). We are not responsible for the content or availability of these sources. Links to Google Maps and Vegkart open external services with their own terms.
11. Liability
The service is provided "as is" during early access. Laminar is not liable for indirect loss, such as lost profit, lost savings, third-party claims or loss resulting from decisions the customer has based on data in the service. Our total liability under the agreement is limited to the amount the customer has paid for the service in the twelve months preceding the claim.
These limitations do not apply in cases of intent or gross negligence, or where they cannot be waived under mandatory law. The customer indemnifies Laminar against third-party claims arising from the customer's content or the customer's breach of these terms.
12. Term, termination and deletion
- The agreement runs until terminated. Either party may terminate in writing with 30 days' notice, unless otherwise agreed.
- We may terminate with immediate effect on material breach that is not remedied within 14 days of written notice, including non-payment.
- The customer can export customer data until the agreement ends, and for up to 30 days afterwards by contacting us.
- Customer data is deleted within 90 days after the agreement ends, unless the customer requests earlier deletion or the law requires longer retention.
13. Changes to these terms
We may change these terms. Material changes are announced by email or in the app at least 30 days before they take effect. The customer may terminate the agreement with effect from the date the change takes effect if it does not accept the change. Continued use after that date constitutes acceptance.
14. Governing law and disputes
The agreement is governed by Norwegian law. Disputes shall first be sought resolved through negotiation. Failing that, either party may bring the matter before the ordinary Norwegian courts, with Agder tingrett as the legal venue.
